Terms of Service.
These Terms of Service ("Terms") govern your access to and use of the ErrSight error tracking and observability service ("Service") operated by Jijo Bose, doing business as ErrSight ("ErrSight," "we," "us," or "our"), based in Bangalore, India. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Definitions
- Account - your registered user account on the Service.
- Customer Data - error events, stack traces, request metadata, user identifiers, and other data you transmit to the Service through our SDKs or API.
- Service - the ErrSight web application, dashboards, and APIs hosted by us, together with the ErrSight SDKs and client libraries, whether hosted by us or installed and run within your own applications, processes, or devices, and any related software.
- Subscription - a paid plan that grants you access to the Service for a billing period.
- Add-On - a one-time purchase that adds 50,000 events and 2 GB of storage to your current billing period for a 30-day rolling window.
2. Acceptance of Terms
By accessing the Service, you confirm you have read, understood, and agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Eligibility
You must be at least 18 years old to use the Service. The Service is not directed to children under 18, and we do not knowingly collect data from minors.
4. Account Registration and Security
You must provide accurate information when creating an Account. You are responsible for:
- Maintaining the confidentiality of your login credentials and API keys.
- All activity that occurs under your Account.
- Notifying us promptly at hi@errsight.com if you suspect unauthorized access.
We use bcrypt to hash passwords. We do not have access to your plaintext password.
5. Subscription Plans and Billing
5.1 Plans
The Service is offered on tiered subscription plans (free and paid). Each paid plan includes a monthly event quota, a storage allowance, and an event retention window. Quotas reset on your subscription anniversary date, not on the calendar month. Current plan details are listed at errsight.com/pricing.
5.2 Add-Ons
Paid-plan customers may purchase Add-Ons. Each Add-On costs 9 USD and grants 50,000 additional events and 2 GB of additional storage, valid for 30 days from purchase. Add-Ons are non-refundable, do not stack beyond the 30-day window, are voided if your Subscription is cancelled, and do not clear any outstanding dunning state.
5.3 Payment Processing
All payments for paid Subscriptions are processed by Dodo Payments, who acts as the Merchant of Record for ErrSight. This means Dodo Payments, not ErrSight, is the legal seller of the Subscription on the transaction record, issues the invoice, collects the payment, and remits applicable taxes to the relevant authorities.
By subscribing to a paid plan, you authorise Dodo Payments to charge your selected payment method on a recurring basis until the Subscription is cancelled. You also agree to Dodo Payments' terms of service and privacy policy, available at dodopayments.com, which govern the payment transaction itself.
ErrSight does not collect, store, or process your full payment card number, CVV, or expiry date. ErrSight stores only the following billing-related identifiers returned to us by Dodo Payments after a successful transaction: your Dodo customer identifier, your Dodo subscription identifier, your current Subscription status and plan name, and references to Dodo-issued invoices.
5.4 Failed Payments and Dunning
If a payment fails, Dodo Payments will retry the charge and we will notify you by email. If payment is not collected within the dunning window, your Account will be downgraded to the free tier and any active Add-Ons will be voided.
5.5 Refunds
Because Dodo Payments is the Merchant of Record for all paid Subscriptions, refunds are governed by the refund policy published by Dodo Payments, available at dodopayments.com. ErrSight does not hold or disburse customer funds and therefore cannot issue refunds directly.
ErrSight will, on a good-faith basis, facilitate a refund request by reviewing your request, submitting it to Dodo Payments on your behalf where appropriate, and adjusting your Subscription status in our systems once Dodo Payments confirms a refund has been processed. The final decision on whether to grant a refund rests with Dodo Payments.
Add-Ons, once consumed in whole or in part, are non-refundable. Unused Add-On quota is voided automatically if your underlying paid Subscription is cancelled. To request a refund, contact us at hi@errsight.com with your account email and the relevant invoice reference.
5.6 Taxes
Because Dodo Payments is the Merchant of Record, Dodo Payments is solely responsible for determining, collecting, and remitting all applicable indirect taxes on your purchase, including VAT, GST, sales tax, and equivalent transaction taxes in your jurisdiction. ErrSight does not assess, collect, or remit transaction taxes on your Subscription. Any questions regarding tax invoices, tax IDs, or reverse charge eligibility should be directed to Dodo Payments through the contact details on your invoice.
5.7 Price Changes
We may change subscription prices with at least 30 days' notice via email to the address associated with your Account. Continued use of the Service after the effective date constitutes acceptance of the new price. If you do not accept the new price, you may cancel your Subscription before the new price takes effect and will not be charged at the new rate.
5.8 Cancelling Your Subscription
You may cancel a paid Subscription at any time from your billing settings inside ErrSight, or from the Dodo Payments customer portal. Cancellations take effect at the end of your current billing period; you retain access to paid features until that date. Once the period ends, your Account is automatically downgraded to the free tier and any active Add-Ons are voided.
When you cancel through ErrSight, we may ask for an optional reason and free-text comment. If you provide either, we store both in our local database for churn analysis and forward both to Dodo Payments alongside the cancellation request so the same context is reflected in their billing record. Providing this information is optional and does not affect the cancellation.
To reverse a scheduled cancellation before the period ends, re-select a paid plan from the pricing page or contact hi@errsight.com.
6. Acceptable Use
You agree not to:
- Transmit unlawful, infringing, defamatory, or harmful content through the Service.
- Send personal data of third parties without a lawful basis.
- Attempt to circumvent quota enforcement, rate limits, or access controls.
- Reverse engineer, decompile, or attempt to extract source code from the Service.
- Use the Service to transmit malware, conduct phishing, or attack other systems.
- Resell, sublicense, or white-label the Service without our written permission.
- Send special category data - including health records, biometric data, payment card numbers, government identifiers, or children's data - through the Service. The Service is not designed to process such data; configure redaction in your application before forwarding data.
We reserve the right to suspend or terminate Accounts that violate this policy.
7. Intellectual Property Rights
The Service, including all software, designs, trademarks, and documentation, is owned by ErrSight. We grant you a limited, non-exclusive, non-transferable right to use the Service during your Subscription. Our SDKs are provided under the MIT License, a copy of which accompanies each published package. To the extent of any conflict regarding the SDKs, the warranty disclaimer in Section 10 and the limitation of liability in Section 11 apply in addition to, and not in derogation of, that license, and the broader protection controls.
8. Customer Data and License Grant
You retain all rights to your Customer Data. You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display Customer Data solely as needed to provide the Service to you. We do not use Customer Data to train machine learning models.
9. Third-Party Services
The Service integrates with third-party providers including Namecheap (VPS hosting), Dodo Payments (billing), and Resend (email). Your use of the Service is subject to those providers' terms where applicable. We are not responsible for third-party services we do not control.
10. Disclaimers, Warranties, and Assumption of Risk
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation. You should not rely on ErrSight as a system of record; treat it as an observability tool. This disclaimer applies equally to the ErrSight SDKs and client libraries, including any that you install and run within your own applications, processes, or devices; you do so at your own risk.
Your responsibilities and assumption of risk. You are responsible for selecting, integrating, configuring, testing, and maintaining the ErrSight SDKs and client libraries in your applications in accordance with our documentation, and for determining their suitability for your environment before deploying them to production. The SDKs are optional and may be removed or disabled at any time, including through the opt-out controls described in the documentation. You assume all risk arising from your installation and use of the SDKs, including any effect on the performance, availability, or behaviour of your own applications. ErrSight is not responsible for issues caused by incorrect integration, misconfiguration, your failure to follow the documentation, or your continued use of an SDK after becoming aware of an issue.
11. Limitation of Liability
To the maximum extent permitted by law, our total aggregate liability arising out of or related to these Terms or the Service shall not exceed the greater of (a) the fees you paid to us in the twelve months preceding the claim, or (b) 50 USD. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunity. This limitation applies to all claims arising out of or related to these Terms, the Service, or the ErrSight SDKs and client libraries, regardless of where they run and regardless of the legal theory asserted. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law.
12. Indemnification
You agree to indemnify and hold harmless ErrSight from any claims, damages, or expenses (including reasonable legal fees) arising from your Customer Data, your violation of these Terms, or your violation of any third-party rights.
13. Term and Termination
These Terms remain in effect while you have an Account. You may cancel a paid Subscription at any time from your billing settings (see Section 5.8); cancellations take effect at the end of the current billing period. You may also delete your Account at any time from your account settings, subject to the requirement that any active paid Subscription be cancelled first.
We may suspend or terminate your Account, in whole or in part, immediately and without prior notice or liability if we determine, in our reasonable discretion, that you have:
- Violated these Terms or our Acceptable Use Policy (Section 6).
- Used the Service to engage in illegal activity, including fraud, money laundering, distribution of malware, phishing, impersonation, or attacks against other systems.
- Sent unsolicited bulk messages, harassed other users, or transmitted abusive, defamatory, or threatening content.
- Failed to pay fees due, including after the dunning window described in Section 5.4.
- Created a risk of legal exposure for ErrSight, our customers, or our infrastructure providers.
- Acted in a way we are required to address by court order, regulator, or applicable law.
For minor or unintentional violations, we will use reasonable efforts to notify you before suspension or termination so you have an opportunity to cure. For urgent violations involving illegal activity, active abuse, or security threats, we may act first and notify you afterwards.
Upon termination by us for cause: (a) paid Subscription fees and any Add-On purchases are non-refundable for the current billing period; (b) any unused quota or Add-On credit is forfeited; (c) your Customer Data will be retained or deleted per the retention schedule in our Privacy Policy; and (d) we reserve the right to preserve and disclose data as required by law or to cooperate with law-enforcement requests, court orders, or regulatory inquiries.
14. Service Discontinuation
We may discontinue the Service, in whole or in part, at our discretion. If we decide to discontinue the Service entirely, we will give at least 30 days' notice by email to the address associated with your Account and by in-app notice. During the notice period you may export your event data using the in-app CSV or JSON export, which is limited to the 10,000 most recent events per project per export and is filterable by environment, level, fingerprint, and release. You may also continue to use the API at the rate limits in effect for your plan.
If we discontinue the Service entirely before the end of a billing period for which you have prepaid, we will, on a good-faith basis, request that Dodo Payments refund the unused, pro-rata portion of your most recent Subscription fee. Because Dodo Payments is the Merchant of Record (Section 5.3), the refund itself is subject to Dodo Payments' refund processing. Add-Ons are non-refundable per Section 5.2 and any unused Add-On quota is forfeited.
After the Service is discontinued, Customer Data will be deleted on the schedule set out in our Privacy Policy. Sections 8 (Customer Data and License Grant), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), 16 (Governing Law), and 17 (Dispute Resolution) survive discontinuation.
15. Modifications to the Service or Terms
We may modify the Service or these Terms at any time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
16. Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-laws principles.
17. Dispute Resolution
Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India.
18. Miscellaneous
- Severability - if any provision is held unenforceable, the remaining provisions remain in full effect.
- Waiver - failure to enforce any right is not a waiver of that right.
- Entire Agreement - these Terms, together with the Privacy Policy, constitute the entire agreement between you and ErrSight regarding the Service.
- Assignment - you may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
